Technical Committee On Constitutional Amendments (TCCA) In Final Phase Of Provincial Consultations

The Technical Committee on Constitutional Amendments (TCCA) is in the second and final phase of its countrywide public sittings to consult Zambians on amendments to the supreme law of the land. In the second phase which started on 3rd November and ends on 13th November, 2025, the Committee is covering Copperbelt, Muchinga, Luapula, Southern and Lusaka provinces. This is after the first part of the Committee’s nationwide public sittings that ended on 30th October, 2025 and covered Central, North-Western, Western, Northern and Eastern provinces.

Courtesy calls

Provincial Administrations are key contact points in the coordination and organisation of the public sittings. They are, therefore, the first office on which the 25-member Technical Committee, divided in five teams, has been paying courtesy calls on arrival in a province.

In Mansa, during a courtesy call on the Provincial Administration, leader of the team assigned to the province, Mr Rabbson Chongo, assured the people of Luapula province that all submissions made during the ongoing consultative process will be reflected in the final report, further reaffirming the Committee’s commitment to transparency and inclusivity in collecting submissions from citizens across the country.

“There are no wrong or right submissions. What we want is to capture the true feelings of the people towards the Terms of Reference. Our undertaking as a Technical Committee is to be faithful to their submissions and reflect their views accurately in our report,” Mr Chongo said.

Mr Chongo further encouraged members of the public to take advantage of the various channels available among them physical and written submissions, virtual sessions and online contributions through which they can participate in this important national exercise.

“This is a national exercise for which we urge all citizens to participate in shaping our Constitution,” he said.

Luapula Province Minister Eng. Nason Musonda commended the Technical Committee for its inclusive approach and assured the team of strong participation from the province.

“We expect a huge turn-out. The Constitution affects everyone – marketeers, bus drivers, church leaders, traditional leaders and civil servants alike. We will use community networks including WhatsApp groups to share online submission platforms so that every voice is heard,” the Provincial Minister said.

In Chinsali, when the Technical Committee paid a courtesy call on traditional leaders from chiefdoms across Muchinga province, Committee Chairperson Justice Christopher Mushabati urged the traditional leadership to encourage their subjects to make submissions to the ongoing constitutional amendment process.

Justice Mushabati said the Committee acknowledges the important role that traditional leaders play in governance, hence the need for them to take a leading role in sensitising their subjects on the Constitutional Amendment process.

“As a Committee, we look forward to fruitful interaction on this important national undertaking, with you our traditional leaders, Justice Mushabati said.

At the same event, Chief Mweniwisi of Mafinga District said traditional leaders in the province have welcomed the Constitutional Amendment exercise that has been embarked upon.

Earlier, the Technical Committee paid a courtesy call on Muchinga Provincial Administration with Provincial Permanent Secretary Rev. Mathews Chekwa, describing the ongoing constitutional amendment process as key in addressing lacunas in the current Constitution.

Sittings

The Technical Committee has structured its programme on Provincial Sittings in a highly consultative and inclusive manner with the first day of the Committee’s Sittings in a province, dedicated to receipt of submissions exclusively from traditional leaders followed by submissions from the general public the next three days. Cognisant of the fact that not everyone can manage to go to the provincial centre to make their submission physically and leveraging on digital technology, the Committee, in collaboration with Smart Zambia and Zambia Information Technology Authority (ZICTA) has set up centres in all the districts countrywide through which members of the public can interact and make submissions to the Committee, virtually. This has significantly widened public participation in this important process.

Terms of Reference

The ongoing Constitutional Amendment process is guided by Terms of Reference which members of the public are encouraged to consider, in their submissions. These include:

  1. Receive submissions from the people of Zambia with respect to provisions relating to the electoral process and the electoral system as a whole, and specifically provisions relating to the delimitation and delineation of Constituencies and Wards with a view to ensure fair, equitable and balanced representation and distribution of resources across the Republic.
  2. The promotion and enhancement of effective participation of Women, Youths and persons with disabilities in elective positions and governance institutions in accordance with the principles of inclusivity, equality and equity
  3. By-elections, considering various factors such as the cost of by-elections
  4. The number of nominated Members of Parliament and
  5. The filing in of fresh nominations after the resignation of a candidate in Presidential, Parliamentary and local government elections, among others.

As the Technical Committee progresses in its nationwide public consultations ‘WE THE PEOPLE,’ are urged to have our voices heard in this important national undertaking by making submissions to the Committee.
